Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Kanso Coders Ltd. ("Company", "we", "us", or "our"), a company registered in the United Kingdom, governing your access to and use of TailStats and any related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

Service Description

TailStats is a software application that provides analytics and monitoring capabilities for Tailscale networks. The Service allows users to view, analyse, and manage their network data and statistics.

User Accounts

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable law or regulation
• Use the Service to transmit or procure the sending of any advertising or promotional material without our prior written consent
• Impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Attempt to gain unauthorised access to, interfere with, damage, or disrupt any parts of the Service, its servers, or any databases connected to the Service
• Use any robot, spider, or other automatic device to access the Service for any purpose
• Introduce any viruses, trojan horses, worms, or other material that is malicious or technologically harmful
• Reverse engineer, decompile, or disassemble any part of the Service

Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Service for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as generally and ordinarily permitted through the Service according to these Terms.

Your Data

You retain ownership of any data you submit, post, or display through the Service ("Your Data"). By using the Service, you grant us a limited licence to access, process, and display Your Data solely as necessary to provide and improve the Service.

You are responsible for ensuring that Your Data does not violate any applicable laws or infringe on the rights of any third party.

Third-Party Services

The Service may integrate with or provide links to third-party websites, services, or applications (such as Tailscale). We are not responsible for the content, terms, or privacy practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

Payment Terms

Certain features of the Service may require payment. If you choose to use paid features:

• You agree to pay all fees associated with your chosen plan
• All fees are non-refundable unless otherwise stated or required by applicable law
• We reserve the right to change our fees upon reasonable notice
• Failure to pay may result in suspension or termination of your access to paid features

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy or reliability of any information obtained through the Service

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KANSO CODERS LTD., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or use of or inability to access or use the Service
• Damages resulting from any conduct or content of any third party on the Service
• Damages resulting from unauthorised access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or one hundred pounds sterling (£100), whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

Indemnification

You agree to defend, indemnify, and hold harmless Kanso Coders Ltd. and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or using the account deletion feature within the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of England and Wales, and you consent to the personal jurisdiction of such courts.

Dispute Resolution

If you have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting us. If the dispute is not resolved within thirty (30) days of submission, either party may proceed with formal legal action as permitted by these Terms.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kanso Coders Ltd. regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
